California was the first state to raise the tobacco age to 21 and, after a voter referendum in 2022, now bans flavoured tobacco products statewide — so California vape shops stock tobacco-flavoured products only.
Vape laws in California
California requires purchasers to be 21 or older and requires retailers of vapour products to hold a state cigarette and tobacco retail licence. The statewide flavour ban (SB 793, confirmed by voters as Proposition 31 in 2022) prohibits selling flavoured tobacco products, including flavoured e-liquids — only tobacco flavour remains on shelves.
California also layers some of the heaviest taxes in the country on vapour products, combining state and local measures: several cities, including San Francisco and Los Angeles, add their own taxes on top of the state level.
