Vape laws in San Francisco
San Francisco has some of the strictest vape rules in the United States, going beyond California's already strict state laws.
Statewide rules (Proposition 31 / AB 3218): all flavoured vape products are banned, and only products on the state's Unflavored Tobacco List (UTL) can legally be sold. The minimum purchase age is 21 with no exceptions, and California's 63.49% vape excise tax applies.
San Francisco-specific rules: in January 2020 the city became the first major city in the United States to ban the sale of all e-cigarettes — flavoured and unflavoured — until the FDA completed a review of each product. The FDA has since authorised a small number of products, so in practice very few vape products are legally available within city limits, and many residents shop in Oakland, Daly City or San Mateo County. San Francisco's smoke-free ordinances also cover vaping in nearly all public indoor spaces and many outdoor areas.
