Vape laws in Georgia

Georgia is one of the more vape-friendly states in the South-east. There is no statewide or local flavour ban on tobacco or vape products, so all flavours of e-liquids, disposable vapes and other vape products are legal for sale to adults 21 and older.

Georgia levies no separate excise tax on vaping products beyond standard sales tax and other tobacco product taxes, which keeps prices lower than in many states. The minimum purchase age is 21 under federal Tobacco 21 law.

Under Senate Bill 47 (2023) vaping is regulated the same way as smoking under the Georgia Smokefree Air Act, so it is banned in most enclosed public places and workplaces. Tobacco stores, cigar bars and bars that admit only patrons aged 18 and over are exempt. Atlanta has adopted comprehensive smoke-free ordinances that go further than state law in some respects, but has not enacted a local flavour ban as of 2026.
